Maine's regulatory framework for employee benefits changed fundamentally in 2026. The state now operates one of the most comprehensive paid leave programs in the country, alongside an existing universal earned leave mandate and employment protections that exceed federal standards in several areas. Portland employers must manage each of these simultaneously.

Maine PFML benefits are now live

As of May 1, 2026, eligible Maine employees can receive up to 12 weeks of paid family and medical leave per benefit year. Qualifying reasons include the employee's own serious health condition, care for a family member, parental bonding, military family leave, and leave related to domestic violence or sexual assault. The maximum weekly benefit is $1,198.84. The program is funded through a 1% contribution on covered wages, split evenly at 0.5% each. Employers with fewer than 15 employees are exempt from the employer share but must still withhold and remit the employee's 0.5%. Aflac administers claims on behalf of the state. Two features distinguish Maine's program. First, employers must continue accruing PTO, vacation, and other paid leave during PFML leave, treating the period as if the employee were actively working. Second, employers cannot require employees to exhaust accrued PTO before or during PFML. Both provisions create coordination challenges that most leave systems are not configured to handle by default.

Private plan alternatives are available but require state approval

Employers may apply to the Maine Department of Labor for approval of a private plan that provides benefits at least equivalent to the state program. If approved before the 30th day before the end of a quarter, the employer is exempt from state contributions for that quarter and beyond. This decision, state plan versus private plan, is one Portland employers should be evaluating now, particularly those whose existing disability and leave programs may create coordination or overpayment issues.

Earned Paid Leave applies to employers with 10 or more employees

Separate from PFML, Maine requires employers to provide one hour of paid leave for every 40 hours worked, up to 40 hours per year. This leave can be used for any reason, not just illness. Effective September 24, 2025, unused leave carries over, allowing employees to accumulate up to 80 hours. This is a universal PTO mandate, not a sick leave law, a distinction that affects how employers design their overall leave architecture alongside PFML.

Maine's minimum wage is $15.10 per hour as of January 1, 2026

The tipped minimum wage is $7.55 per hour. Portland's local minimum wage may exceed the state rate, so employers should confirm the applicable rate based on where work is performed. The exempt employee salary threshold rose to $871.16 per week, or $45,300.32 annually. These thresholds affect benefits eligibility classifications and overtime calculations across Portland's hospitality, healthcare support, and retail sectors.

Pay transparency takes effect July 13, 2026

Maine's new pay transparency law will require employers to include wage ranges in all job postings.
